Have you been let down by a Professional ?

Whether you are a business or individual you will at some point require the services of a professional whether this is a lawyer, accountant, financial adviser, surveyor or doctor. Irrespective of the type of professional service you engage in, there is a certain level of expectation in the service that is provided.

Do I have a claim?

If you have been let down by a professional you may be entitled to bring a claim. Essentially, in order to bring a claim you would have to establish the following:

  1. That you were owed a duty of care.
  2. That duty was breached
  3. You have suffered loss as a result of the breach of duty of care.

Am I owed a Duty of Care?

In the majority of instances the fact that you have instructed a professional to act for you imposes a duty of care on them. In other instances, a duty of care will be implied where the professional has held him / herself out as having certain expertise.

Is there a Breach of the Duty of Care?

This is a matter of evidence and will be fact sensitive to each individual case. This is where we can assist in determining whether or not the professional has indeed breached their duty of care towards you.

Have you suffered Loss?

In order for you to be eligible to claim you must show that you have suffered a loss and that loss was caused as a result of the breach of duty of care by the professional in question. We can assist in determining this point for you.
