As fraudulent whiplash claims continue to rise, the Government has announced plans to target fake claimants—as of next year, under the new system, only evidence from accredited professionals will be taken into account when claims are assessed. More than 500,000 whiplash claims were made in Britain last year, costing the insurance industry approximately £2bn and adding £90 to the average premium. There have also been recent calls for cars to be fitted with in-vehicle cameras, as both a deterrent and a tool for gathering evidence.

“Crash-for-cash” schemes have become more common in recent years, in which fraudsters stage accidents—by deliberately crashing into other vehicles—in order to make whiplash claims. These new Government proposals will require a panel of qualified professionals to assess each whiplash case and validate its worth. Ministry Of Justice Decides against increasing Small Claims Track Limit

Parmar Solicitors, specialists in a wide range of personal injury claims, comment as the Ministry of Justice (MOJ) rejects plans to increase the small claims track threshold from £1,000 to £5,000.

The MOJ has rejected proposals to raise the small claims track threshold from £1,000 to £5,000, which would have had a detrimental effect on many drivers seeking whiplash claims above the limit. The threshold increase was part of the MOJ’s efforts to reduce the number of whiplash claims being filed, particularly fraudulent cases, which are raising premiums and allowing unethical drivers to benefit at the cost of others. However, the MOJ’s proposal to have all whiplash claims assessed by an independent panel of accredited professionals has been passed, and will come into effect next year.

The MOJ is believed to have rejected the increase because previous reforms need more time to take effect, and would have resulted in genuine claimants being unable to receive compensation they may be entitled to; however, they have not ruled out introducing an increase in the future.
